1. **SERVICES PROVIDED**  
Provider agrees to deliver a mobile, hands-on educational enrichment program involving supervised activities using natural materials (including but not limited to minerals, sand, and plaster) at the location and time agreed upon by the Client.

2. **PARTICIPANT RESPONSIBILITY & CONSENT**  
The Client represents and warrants that:  
- It has obtained all necessary parental/guardian permissions for participating minors.  
- It has disclosed any known allergies, sensitivities, or relevant medical conditions.  
- Participants are permitted to engage in hands-on activities.  
- Provider is not responsible for undisclosed or disclosed conditions.  
 

3. **SUPERVISION & NON-CUSTODIAL SERVICES**  
The Client acknowledges that:  
- Crystal Kiddos provides structured activity supervision only.  
- Crystal Kiddos is not a childcare, babysitting, or custodial service.  

The Client agrees that:  
- It is solely responsible for the general supervision, custody, and control of all participants.  
- It will provide adequate staff/chaperones at all times.  

Provider staff will supervise the activity itself but:  
- Are not responsible for monitoring participants outside the activity area.  
- Will not leave the activity area to follow or retrieve participants, as doing so would require leaving other participants unattended.

4. **SAFETY REQUIREMENTS & PARTICIPANT CONDUCT**  
The Client acknowledges and agrees that:  
- All participants must follow safety instructions provided by Crystal Kiddos staff at all times.  
- Safety glasses (or required protective equipment) must be worn during designated portions of the activity.  

Provider reserves the right to:  
- Refuse participation to any individual who does not follow safety protocols.  
- Remove or deny continued participation to any participant who is behaving in a disruptive, unsafe, or non-compliant manner.  

The Client agrees that:  
- Participants who refuse to follow safety rules will not be permitted to continue the activity.  
- Misbehaving participants must be immediately supervised and managed by Client staff/chaperones.  
- Crystal Kiddos staff are not responsible for managing behavioral issues beyond the scope of the activity.

5. **MATERIALS & ACTIVITY RISK ACKNOWLEDGMENT**  
The Client understands and acknowledges that:  
- Activities involve natural minerals and materials.  
- The hands-on nature of the activity may generate dust and small particles during participation.  
- All activities are conducted in a supervised, low-risk environment.  

It is acknowledged that participants will receive a crystal/mineral to retain as a party favor. Upon exit from the activity area with said item, all responsibility transfers to the parent/guardian, who assumes all risk of injury, ingestion, or misuse and releases Crystal Creative LLC from any and all liability.

6. **LIABILITY WAIVER**  
To the fullest extent permitted by law, the Client agrees that participation is voluntary and assumes all inherent risks associated with hands-on activities.  

The Client agrees to release and hold harmless Crystal Kiddos, its owners, employees, and contractors from any claims, damages, or liabilities arising from participation, except in cases of gross negligence or willful misconduct.

 

7. **INDEMNIFICATION**  
The Client agrees to indemnify, defend, and hold harmless Crystal Kiddos from and against any and all claims, damages, losses, or expenses (including legal fees) arising out of or related to:  
- Participant actions or behavior.  
- Failure to supervise participants.  
- Undisclosed or disclosed medical conditions or sensitivities.

8. **INSURANCE**  
Client acknowledges that Crystal Kiddos maintains general liability insurance.

 

9. **PHOTO AND MEDIA RELEASE**  
The Client grants permission for Crystal Kiddos to photograph or record participants during activities for promotional and marketing purposes, unless the Client provides written notice declining such use prior to the event.

10. **ENTIRE AGREEMENT**  
This Agreement represents the entire understanding between the parties and supersedes any prior discussions or agreements.

11. **ACCEPTANCE**  
By signing below, the Client acknowledges and agrees to all terms outlined above and confirms it is signing on behalf of all participants and/or their guardians.
